1. Parties and acceptance

These terms govern the use of Flubyx, a platform operated by Goenlace SAC (RUC 20613495925), with address at Calle Dona Cecilia 119, Peru. By signing up or using Flubyx you accept these terms and the Privacy policy. If you accept them on behalf of a company, you declare that you are authorized to bind it; in that case, "the customer" is that company.

2. The service

Flubyx is a cloud service that connects to the databases the customer authorizes in order to generate KPIs, reports and dashboards with the help of artificial intelligence. Depending on the plan, it includes: database connections, a data model (KPIs, dimensions and relationships) proposed with AI and approved by the customer, dashboards, data exploration, natural-language questions, CSV export, printing and read-only public links.

Flubyx accesses databases in read-only mode only: it does not modify, delete or permanently copy the customer's records. The artificial intelligence never writes or runs queries on the customer's database; Flubyx compiles and validates every query.

3. Sign-up and account

  • You must be 18 or older and provide truthful information. We verify your email.
  • You are responsible for keeping your password confidential and for the actions taken with your user. We recommend enabling two-step verification.
  • Let us know immediately if you suspect unauthorized use.

4. Companies, team and roles

Each account (company) has an owner, who can invite other people as administrators, editors or viewers. The owner is responsible for the users they invite, their permissions and removing them when they should no longer have access. Invitations expire after 7 days. Only the owner manages the subscription and payments. The number of users, connections and dashboards depends on the plan.

5. Connections to the customer's databases

The customer declares that it is authorized to connect the databases it registers and that their use in Flubyx complies with the law, including personal data protection rules. It is responsible for creating database users with minimal permissions, preferably read-only (Flubyx checks this when testing the connection), and for allowing in its firewall the outbound IP address we indicate. Flubyx only connects to servers reachable from the internet.

6. Artificial intelligence

AI proposals (names, KPIs, relationships, answers to questions) are suggestions: the customer must review and approve them before using them to make decisions. If the customer uses its own key from an AI provider, that usage is billed directly by the provider under its terms. If it uses the Flubyx AI, the plan includes a monthly usage quota.

7. Plans, free trial and prices

  • Plans and their limits are published on the pricing page. Prices are in US dollars (USD), plus any applicable taxes as shown before payment.
  • Every new account starts with a 15-day free trial, with no card required. When the trial ends, if no plan is chosen, use of the account is blocked until one is purchased; billing and the profile remain available.
  • We may change prices with prior notice; the change applies from the next renewal.

8. Payments and renewal

  • Payments are made by card through our payment gateway (Culqi). Flubyx does not store the card number.
  • The subscription renews automatically every month or year, according to the chosen cycle, with the registered card.
  • If you pay during the trial, your paid period starts when the trial ends.
  • When upgrading, the proportional difference for the remaining days is charged immediately; when downgrading or switching from annual to monthly, the change applies at the end of the paid period; when switching from monthly to annual, the unused balance is deducted.
  • If a charge fails, we will retry it and notify you by email. If it is not resolved within the grace period (7 days), use of the account is blocked until the card is updated.
  • We will email you a summary of each payment. The electronic receipt is issued in accordance with tax rules.

9. Cancellation and refunds

You can cancel the subscription at any time from Billing. Cancellation takes effect at the end of the period already paid, and you can resume it before that date. Unless the law provides otherwise or the charge was wrong, there are no refunds for partial periods. This does not limit your rights under Peru's Consumer Protection Code.

10. Acceptable use

It is not allowed to: connect databases without authorization; attempt to breach the security of Flubyx or other customers; intentionally overload the service or the databases; use the platform for unlawful purposes; resell the service without a written agreement; or share access credentials. We may limit usage to protect the service (for example, the number of simultaneous queries per database).

11. Availability, maintenance and support

We make reasonable efforts to keep Flubyx available, but the service also depends on the internet and on the availability of the customer's databases and external providers. We may carry out scheduled maintenance, giving notice whenever possible. Support is provided through the help button on the platform and by email; special service levels only apply if agreed in writing (for example, on the Custom plan).

12. Intellectual property and customer data

Flubyx, its software, design and brand belong to Goenlace SAC. We grant you a limited, non-exclusive and non-transferable license to use the service while your account is active. The data in your databases, your data model and your dashboards are yours.

13. Personal data and confidentiality

We process personal data in accordance with our Privacy policy. Regarding personal data contained in the customer's databases, Flubyx acts as a data processor and uses it only to provide the service. We keep the customer's information confidential.

14. Public links

The customer decides which dashboards to share through public links, their validity and their revocation, and is responsible for the information shared that way.

15. Liability

To the extent permitted by law, Flubyx is not liable for decisions made based on the information or the AI suggestions, for the accuracy of the customer's source data, for failures of external providers or the customer's databases, or for indirect damages or lost profits. Flubyx's total liability for any claim is limited to the amount paid by the customer in the 12 months before the event. These limitations do not apply in cases of willful misconduct or gross negligence, nor to non-waivable consumer rights.

16. Suspension and termination

We may suspend or close an account that breaches these terms, endangers the security of the service or upon an order from an authority, notifying you whenever possible. The customer can stop using the service at any time by cancelling its subscription.

17. Handling claims

You can file a claim or complaint in our virtual Complaints Book, linked in the website footer. We will reply within no more than 15 non-extendable business days. Filing a claim does not prevent you from using other channels and is not a prerequisite for filing a complaint with INDECOPI.

18. Changes to these terms

We may modify these terms. We will publish the new version with its date and, if the changes are significant, we will notify you reasonably in advance on the platform or by email. If you keep using Flubyx after they take effect, you are deemed to accept them.

19. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Peru. Any dispute will be submitted to the judges and courts of Cercado de Lima, without prejudice to consumer rights and the jurisdiction of INDECOPI.
